General Terms and Conditions for Tickets and Other Services

1. Scope

The following General Terms and Conditions (GTC) apply to all services provided by Stiftung Haus der Kunst München, gemeinnützige Betriebsgesellschaft mbH (hereinafter “Haus der Kunst München”) in connection with the booking, sale and delivery of admission tickets (hereinafter “Tickets”) and other services and items offered by Haus der Kunst München (hereinafter “Goods”), provided they are booked via the Haus der Kunst München online shop at tickets.hausderkunst.de (hereinafter “online bookings”).

2. General information on online bookings

2.1 The online shop at tickets.hausderkunst.de is operated on behalf of Haus der Kunst München by München Ticket GmbH, Seidlstr. 30, 80335 Munich. München Ticket GmbH acts exclusively as a commercial agent in the name and on behalf of Haus der Kunst München. Contractual relationships are established exclusively between the customer and Haus der Kunst München.

2.2 The General Terms and Conditions of München Ticket GmbH can be viewed at www.muenchenticket.de/agb.

2.3 In order for the customer to be authorised to make online bookings, a (one-off) online registration is required, during which the customer sets their own password. The password and other customer details can be changed by the customer at any time via their customer account (“My Account”). Haus der Kunst München recommends changing the password at regular intervals. The customer is responsible for ensuring that no unauthorised third parties gain knowledge of their password. The customer is liable for any culpable misuse caused by them. Online bookings can also be completed as a guest without registration.

3. Data security

3.1 München Ticket GmbH uses a secure procedure for the online transmission of customer data as part of the ordering process (see www.muenchenticket.de/agb, section 12.). For payment transactions, the personal data required for this purpose is transmitted, upon request, to the credit institution or the institution commissioned to process the payment. In the case of postal or parcel delivery, the personal data required for this purpose is transmitted to the delivery company. All data provided by the customer is processed and used in compliance with the data protection regulations applicable to the transaction and the storage of such data. Provided the customer has given their consent during registration, personal data will be used for customer service purposes and to inform the customer about offers from Haus der Kunst München.

3.2 Haus der Kunst München and München Ticket GmbH shall not disclose customer data to third parties.

4. Conclusion of the contract

By initiating an online booking, the customer makes an offer within the meaning of Section 145 of the German Civil Code (BGB) to conclude a contract with Haus der Kunst München.

The customer will receive online confirmation of receipt of the offer to enter into a contract (acknowledgement of receipt). The acknowledgement of receipt does not constitute acceptance of the offer. Acceptance of the offer by Haus der Kunst München shall only take place following prior payment of the purchase price, upon dispatch of the tickets or goods. Acceptance by Haus der Kunst München is subject to the availability of the goods ordered.

5. Payment and Retention of Title

5.1 The following payment methods are available for online bookings in Haus der Kunst München webshop:

§ a) Credit card (MasterCard / VISA);

§ b) Google Pay & Apple Pay;

§ c) PayPal.

5.2 The tickets or goods remain the property of Haus der Kunst München until full payment has been made.

6. Ticket Sales

6.1 Prices

6.1.1 The prices published online apply. Prices include the applicable statutory value-added tax.

6.1.2 Haus der Kunst München issues discounted tickets to certain individuals and/or groups of people. The customer is responsible for checking whether they meet the personal eligibility criteria for the discounts on offer. The eligibility criteria for claiming the discount must be met on the day of the museum visit. The customer must prove their eligibility to the admissions staff upon request by presenting photo ID. Failing this, the difference between the reduced price and the full ticket price must be paid before admission.

6.2 Complaints

The customer is obliged to check the tickets immediately upon receipt of the order confirmation sent by email and upon receipt of the tickets themselves to ensure that the quantity, prices, date, time, event and venue are correct. Complaints regarding incorrect tickets must be made without delay (usually within five working days) of receiving the delivery or the order confirmation; in the case of last-minute online bookings, no later than two working days before the tickets’ validity date. The complaint must be made in writing, either by email to besucherservice@muenchenticket.de, or by post to München Ticket GmbH, Visitor Services, PO Box 201413, 80014 Munich.

6.3 Postage

6.3.1 At the customer’s request, tickets within Germany may also be sent by post or parcel service. A flat-rate postage fee of EUR 6.90 will be charged for this. The tickets will be sent to the customer immediately after payment has been received. Haus der Kunst München reserves the right to select the delivery company at its discretion.

6.3.2 Haus der Kunst München offers its customers the option to print their tickets themselves (this does not apply to Haus Club memberships or annual passes). The “Print@Home” option is available for this purpose. Immediately after the ordering process, the tickets are sent by email and can be printed on the customer’s own printer. For admission control, the tickets are electronically scanned and validated upon a single scan.

The following terms of use must be observed:

The ticket must be printed on white A4 paper.

The Print@Home ticket becomes invalid if it is folded incorrectly (over the barcode), soiled, damaged, etc.

In the event of loss or duplication, there is no entitlement to admission or a replacement.

6.4 Annual Pass and Haus Club Membership

6.4.1 The Annual Pass is available until 29.09.2026 and will thereafter be replaced by Haus Club Membership. Annual Passes already purchased remain valid.

6.4.2 The Annual Pass and Haus Club Membership are each valid from the start date specified by the customer. The validity period is 12 months. The customer must report the loss of the Annual Pass or Haus Club Membership card immediately in writing, by email to mail@hausderkunst.de. In the event of the loss of an Annual Pass or a Haus Club Membership card, a replacement card may be issued for a fee (3 EUR); the previous card will then be invalidated. Haus Club Membership is non-transferable; where necessary, admission staff may require the presentation of a valid photo ID. When purchasing a Haus Club Membership with a companion (+1), the contract is concluded exclusively with the person placing the order.

6.4.3 For organisational reasons, individual sections of the exhibitions may be temporarily closed.

6.4.4 We reserve the right to make changes to the exhibition and events programme. Booking or reservation may be required for certain guided tours or other events. Where applicable, free time-slot tickets must be purchased in advance of a visit using an Annual Pass or Haus Club Membership. The customer is advised to check the website in advance for further information. Annual Passes and Haus Club Membership do not entitle the holder to preferential treatment (e.g. in the event of full capacity or time-slot restrictions).

6.4.5 In the event of the unauthorised transfer of the Annual Pass or Haus Club Membership card to third parties, Haus der Kunst München is entitled to terminate the relevant contractual relationship without the customer being entitled to compensation and/or reimbursement of costs.

6.5 Visitors’ Regulations

By purchasing tickets, the customer accepts the Visitors’ Regulations of Haus der Kunst München as binding. When purchasing an Annual Pass with a partner pass or a Haus Club Membership with a companion (+1), the customer must inform the respective partner or companion of the Visitors’ Regulations.

7. Sale of Goods

The provisions of this Section 7 apply only to the sale of goods, not to the sale of tickets.

7.1 Withdrawal

Haus der Kunst München is entitled to withdraw from the contract if a supplier fails to deliver the ordered goods to Haus der Kunst München correctly or on time, despite Haus der Kunst München having concluded a corresponding hedging transaction. In this case, the customer will be informed immediately that the goods ordered are not available. Any purchase price already paid will be refunded without delay.

7.2 Delivery and delivery charges

7.2.1 Haus der Kunst München will deliver the goods ordered to the address specified by the customer in the order. Haus der Kunst München reserves the right to make partial deliveries.

7.2.2 Goods are delivered at the delivery charges specified in each individual case.

7.2.3 Customs duties or import charges may be incurred in the country of destination for deliveries abroad. Such costs are to be borne by the customer; Haus der Kunst München has no influence over these charges and is therefore unable to predict their amount. Customs regulations vary considerably from country to country. The customer may obtain relevant information from their local customs office. As the importer, the customer must comply with the relevant national regulations.

7.3 Warranty

7.3.1 Haus der Kunst München is liable for material defects in accordance with the applicable statutory provisions, in particular Sections 434 et seq. of the German Civil Code (BGB). If the goods are defective, Haus der Kunst München shall subsequently provide rectification, i.e. either a replacement delivery or the rectification of the defects. If the form of subsequent performance chosen by the customer is only possible at disproportionate cost, Haus der Kunst München is entitled to provide subsequent performance in the other form. If Haus der Kunst München is unable to provide subsequent performance, the customer has the right, at their discretion, either to rescind the contract of sale or to claim a reduction in the purchase price.

7.3.2 An additional guarantee applies to the goods delivered only if such a guarantee has been expressly provided for the goods in question.

8. Liability

8.1 Claims by the customer for damages against Haus der Kunst München are excluded.

8.2 This does not apply to the customer’s claims for damages arising from injury to life, limb or health, or from a breach of fundamental contractual obligations (cardinal obligations), nor to liability for other damages resulting from an intentional or grossly negligent breach of duty by Haus der Kunst München, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfilment is necessary to achieve the purpose of the contract.

8.3 In the event of a breach of essential contractual obligations, Haus der Kunst München shall only be liable for foreseeable damage typical of the contract if such damage was caused by simple negligence, unless the customer’s claims for damages arise from injury to life, limb or health.

8.4 The limitations of liability shall not apply where Haus der Kunst München has fraudulently concealed a defect or has given a guarantee as to the quality of the item.

8.5 The provisions of the Product Liability Act remain unaffected.

9. Cancellation Policy

9.1 Right of Cancellation

The customer has the right to cancel the contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which the customer, or a third party designated by the customer (other than the carrier), took possession of the goods.

To exercise the right of withdrawal, the customer must inform us of their decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, although this is not mandatory. The notice of withdrawal must be sent to:

To meet the withdrawal deadline, it is sufficient for the customer to send notification of their intention to exercise their right of withdrawal before the withdrawal period expires.

9.2 Consequences of withdrawal

In the event of withdrawal, Haus der Kunst München shall refund the purchase price already paid, including delivery costs (with the exception of any additional costs arising from the customer having chosen a method of delivery other than the cheapest standard delivery offered), to the customer within fourteen days of receiving the notice of withdrawal at the latest.

For this refund, Haus der Kunst München will use the same payment method that the customer used for the original transaction, unless expressly agreed otherwise with the customer; under no circumstances will the customer be charged any fees in connection with this refund.

The refund may be withheld until Haus der Kunst München has received the goods back or until the customer has provided proof that the goods have been returned, whichever is the earlier.

The customer must return or hand over the goods no later than fourteen days from the date on which the customer notified Haus der Kunst München of the withdrawal. The deadline is deemed to have been met if the customer dispatches the goods before the expiry of the fourteen-day period.

The customer must bear the direct costs of returning the goods.

The customer shall only be liable for any loss in value of the goods if such loss is attributable to handling of the goods that goes beyond what is necessary to ascertain their nature, characteristics and functioning.

9.3 Exclusion of the right of withdrawal

The right of withdrawal does not apply to the following contracts:

a) Contracts for the supply of audio or video recordings or computer software in a sealed package, if the seal has been broken after delivery (Section 312g (2)(6) of the German Civil Code (BGB));

b) Contracts for the provision of services in the areas of accommodation for purposes other than residential purposes, the carriage of goods, motor vehicle hire, the supply of food and drink, and the provision of other services in connection with leisure activities, where the contract specifies a specific date or period for the provision of the service (Section 312g (2)(9)). This means that, insofar as Haus der Kunst München offers services in the field of leisure activities, in particular time-specific tickets, there is no right of withdrawal. Any order for time-specific tickets is therefore binding immediately upon confirmation by the Haus der Kunst München in accordance with clause 4 and obliges the customer to accept and pay for the ticket ordered.

c) In all other respects, the statutory exceptions under Section 312g (2) of the German Civil Code (BGB) apply.

10. Governing Law and Jurisdiction

10.1 Contracts between Haus der Kunst München and the customer are governed by the law of the Federal Republic of Germany, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The statutory provisions restricting the choice of law and governing the applicability of mandatory provisions – in particular those of the country in which the customer, as a consumer, has their habitual residence – remain unaffected.

10.2 Where the customer is a trader, a legal person governed by public law or a special fund under public law, Munich shall be the place of jurisdiction for all disputes arising from contractual relationships between the customer and the Haus der Kunst München.

11. Severability clause

Should any individual provisions of these General Terms and Conditions be or become void, the remaining provisions shall remain valid.

The invalid provisions shall be replaced by the provision customary in the industry applicable in such cases; in the absence of a valid industry-standard provision, the relevant statutory provision shall apply.
